STATEMENT OF FACTS

• On 01st of June, 2017 a Leave and License Agreement was drawn between me and Mr. Sanjeev Raj Bawa and his wife Mrs. Ritu Bawa in order to allow them to stay at my Ownership residence at 12-C, Block 1, Silver Springs, 5 J.B.S Halden Avenue, Kolkata 700105, for a monthly payment of Rs. 50,000/- (in words: Rupees Fifty Thousand only). The Leave and License Agreement was made for a period of eleven (11) months.

• On 15th of January, 2018 on completion of eight months, Mr, Sanjeev Raj Bawa and Mrs. Ritu Bawa issued me a notice on a Rupees Twenty (Rs 20/-) Indian Non Judicial stamped paper No. 22AA783818 stating their willingness to vacate the apartment on 15th of February 2018. The stamp paper, Kramik No. 1276, dated 10-Jan-2018 was issued to Mrs. Ritu Bawa, 5 J.B.S. Halden Avenue, Kolkata 700105. The copy of the same is attached herewith for you kind reference.

• Furthermore, the rent of the apartment (Rs. 50,000/-) was paid to me until 15th of March, 2018 and they informed me their willingness to vacate the apartment finally by 22nd of April, 2018.

• Thereafter, all attempts for communication with Mr. Sanjeev Raj Bawa (tel no. 9830092677) and his associate Mr. Anand Makhija (tel. no. 7003914799) (who had earlier visited my residence on several occasion to handover the rents) was declined by them. The Telephone calls were not received and acknowledged. I and my husband Capt. Sumon De had tried on several occasions, but were unsuccessful to communicate with either of them.

• On 14th of May, 2018, a Court Notice was served to me with false allegations and a fraudulent Tenancy Agreement was mentioned there-in, which never existed. The Suit No. 689 of 2018 was shockingly served to me apparently with the ulterior motive of malice and simple intention to cheat me.
• I had defended the case by appointing Advocates Mr. Rajdeep Mazumder (tel no. 9831113098), Mr. Moyukh Mukherjee (tel. no. 9007133195) and Mr. Kaustav Lal Mukherjee (tel. no. 7003453807). The documents of the proceeds of the case is enclosed herewith for your kind reference and understanding.

• During the above trial proceedings my case was not presented correctly in Court by my previously appointed Lawyers to the extent that malpractices were carried out and even wrong court orders and judgements were handed to me. The reason for which is still unknown.

• Advocate, Mr. Rajdeep Mazumdar had procured the fraudulent Tenancy Agreement and two false “Rent Slips” with my forged signature from the Court Records that was submitted to Court by Mr. Sanjeev Raj Bawa and Mrs. Ritu Bawa. I also found that the false “Tenancy Agreement” did not bear my Signature. In the “Rent slips” my signature was blatantly forged. It is shocking that such forged and fraudulent documents were submitted to the learned Court without any regard and respect for the Judiciary System of the Country. It clearly shows intention of malice, deceit and pure dishonesty on the part of Mr. Sanjeev Raj Bawa and Mrs. Ritu Bawa.

• The Authenticity of my signature in the above documents has been verified by M/s J. K. Consultancy, an ISO 9001:2008 Organisation based in New Delhi, Recognised by Government of India. Their Report is enclosed herewith for your kind perusal. The expert Representative from the Company can attend Court and bear witness regarding the authenticity of their Report and verification of the forged signatures in the “Rent Slips” submitted to Count by Mr. Sanjeev Raj Bawa and Mrs. Ritu Bawa.

• Since 15th of March, 2018 till 31st October, 2019, Mr. Sanjeev Raj Bawa and Mrs. Ritu Bawa have been enjoying the possession of my apartment without paying any rent and as illegal occupants in guise of a falsely fabricated Court suit served by them.

• For your kind information, the total outstanding rent due to me from 15th of March 2018 to 31st of October 2019 is calculated as below :-

– SUMMARY –

My Prayer to you and the learned Court.

1. The submission of the falsely fabricated and fraudulent “Tenancy Agreement” (without my valid signature) and my forged signature on the “Rent Slip” to Court with malicious intention to cheat by Mr. Sanjeev Raj Bawa and Mrs. Ritu Bawa needs to be immediately addressed in Court and dismissed & made null and void. Proper penalty / punishment to be meted out to them for such wrong doings, cheating and dishonesty.

2. The outstanding and overdue total rental amount of Rs. 10,30,625/- (in words: Rupees Ten lakhs, thirty thousand, six hundred and twenty five only) for possession of my flat as per the Original Leave and License Agreement, calculated and shown above to be paid to me by Mr. Sanjeev Raj Bawa and Mrs. Ritu Bawa as soon as possible.

3. An “One Month Notice” for eviction to be served to Mr. Sanjeev Raj Bawa and Mrs. Ritu Bawa in line with the Law and proper court procedures in order for them to peacefully vacate the said premises. I do not want to let my apartment be used by such people with evil intent.

4. I humbly request Court to inspect and witness the condition of the apartment upon their finally vacating the flat.

5. I request to complain and report to the Bar Council against my previous Advocates for malpractice. Neither did they correctly address my honest requirements to the court nor defend my case properly. Also for issuing my false court orders.

6. The Interim Injunction issued to me by Mr. Sanjeev Raj Bawa and Mrs. Ritu Bawa with the motive of malice needs to be addressed and dismissed in court at the earliest.
